There’s been a dramatic twist in the battle over the proposed Orchard Hills waste facility with the company proposing the concept going into administration.
State Member for Mulgoa, Tanya Davies, confirmed this afternoon that she’s received advice that Dellara Pty Ltd is in voluntary administration.
Dellara applied for permission to operate an industrial waste facility in Orchard Hills, which prompted major opposition from the public.
Penrith City Council initially rejected the application, however Dellara appealed the decision and the case was heard in the Land and Environment Court.
Court proceedings have finished and a judgment is pending.
Mrs Davies has received advice that the judgment will not be affected by Dellara Pty Ltd’s move to voluntary administration because the application is determined for the property rather than for the owner.
If the court does give development consent, this will be passed to the liquidator as part of the site’s assets.
