St Clair man charged after driving with 10 unrestrained passengers

A motorist has been charged after allegedly driving with 10 unrestrained passengers – including nine children – in Colyton today.

Just before 9am, officers from Nepean Police Area Command were patrolling on Shepherd Street in Colyton, when they spotted a passenger, travelling in a Nissan Elgrand, not wearing a seatbelt as the vehicle turned onto Marsden Road.

Officers stopped the vehicle and spoke with the driver, a 45-year-old man.

Police will allege in court that the front seat passenger, a 34-year-old woman, was not wearing a seat belt as were nine other passengers – all children aged between one month old to 12-years-old.

It will further be alleged that a 12-year-old girl had a two-year-old girl sitting in their lap while an 11-year-old girl was carrying a one-month-old in her arms; all four were not properly restrained.

The driver was issued a Court Attendance Notice (CAN) for 10 offences, including drive with unrestrained passenger (16 years or older), three counts of drive with under seven years old not restrained as prescribed, three counts of drive with person over seven years and under 16 years old not restrained as prescribed, drive with child under 6 months not restrained as prescribed, and two counts of drive with over six months and under four years old not restrained as prescribed.

The St Clair man is due to appear before Penrith Local Court on March 19.

Child at risk notifications have been made.
